Big Changes to the DMV Point System
The NY Department of Motor Vehicles has adopted sweeping amendments affecting points, lookback periods, negative units, relicensing standards and lifetime revocation thresholds.
The enforcement of these rules and regulations begin today, February 16, 2026.
Points
Some of the most notable changes in the point system include:
- 11 points: Aggravated Unlicensed Operation/Any conviction involving operation of a motor vehicle while your license is suspended or revoked (previously 0 points)
- 11 points: Any alcohol or drug-related conviction (previously 0 points)
- 8 points: Passing a stopped school bus (previously 0 points)
- 8 points: Speeding in a work zone (previously, points were assigned by the speed)
- 8 points: Exceeding height restrictions on a highway/striking a bridge or highway structure (previously 0 points)
- 5 points: Speed contests and racing (previously 0 points)
- 5 points: Leaving the scene of a personal injury accident (previously 3 points)
- 5 points: Facilitating Aggravated Unlicensed Operation (previously 0 points)

Lookback Period
The point accumulation period has been expanded from 18 months to 24 months. This expansion makes it much easier to accumulate excessive points in any one period, resulting in license suspension.
Excessive Points Hearings
Motorists may be required to attend a hearing to investigate habitual or persistent violation of rules after accumulating 11 or more points within the 24-month period . This hearing may result in extra suspension or revocation.
Driver Improvement Clinic
A motorist may be required to attend a driver improvement clinic when they have accumulated between 7 and 10 points within a 24-month period. Failure to attend may result in the suspension of the motorist's license.
